Terms of Service

These Terms of Service (the "Terms") set out the conditions for using ProPlayer (the "App"). By using the App, the user (the "User") is deemed to have agreed to these Terms.

1. Application

These Terms apply to all relationships concerning use of the App. The App is distributed through Apple's App Store, and the App Store's terms of use (such as Apple's terms of service) also apply.

2. License

• The App's developer grants the User a non-exclusive right to use the App in accordance with these Terms.
• The User may use the App for private and lawful purposes.

3. Audio and User Responsibility

• The App is a tool for importing audio files that the User has prepared themselves and playing, analyzing, processing, and exporting them.
• The User warrants that they hold the lawful right to use the audio they import.
• The developer bears no responsibility whatsoever for the import, use, or distribution of audio that infringes copyright or other rights.
• Use of audio processed or exported with the App is at the User's own responsibility.

4. Prohibited Conduct

In using the App, the User must not engage in any of the following:

• Acts that violate laws or public order and morals
• Acts that infringe the copyright, intellectual property, or other rights of third parties
• Reverse engineering, decompiling, modifying, or redistributing the App
• Interfering with the operation of the App or using it improperly

5. Intellectual Property

Intellectual property rights in the App and its associated programs, designs, trademarks, and the like belong to the developer or the rightful owner. The license under these Terms does not constitute a transfer of these rights. Rights in the audio the User imports belong to the rights holders of that audio.

6. Disclaimer

• The App is provided "as is" and does not guarantee fitness for a particular purpose, accuracy, completeness, or availability.
• Loudness measurements and analysis results are reference information, and their accuracy is not guaranteed.
• The developer bears no responsibility, to the extent permitted by law, for damages (including loss or corruption of data) arising from use or inability to use the App. Please back up important data in advance.

7. Changes to These Terms

The developer may change these Terms without notice to Users when deemed necessary. The revised Terms take effect once posted on this page. If a User continues to use the App after a change, the User is deemed to have agreed to the revised Terms.

8. Governing Law and Jurisdiction

The interpretation and application of these Terms are governed by the laws of Japan. In the event of a dispute concerning the App, the court having jurisdiction over the developer's location shall be the court of exclusive agreed jurisdiction for the first instance.
